NEXLVL CREATOR AGREEMENT

Version 2026-10-v3

This agreement covers the NexLvl Creator Program between you and NexLvlCharlotte. It's written in plain English so nothing is a surprise. Your dashboard always shows your current rate, your jobs and your earnings.

1. How you earn commission

  • •You earn your tier's rate (Insider 30%, Partner 35%, Ambassador 40%) on NexLvl guide purchases made through your link or code.
  • •A sale counts if the buyer tapped your link within 30 days before buying. If they tapped another creator's link after yours, the most recent link gets the credit.
  • •Purchases you make yourself, refunded orders and chargebacks don't earn commission. A commission already paid for an order that is later refunded may be deducted from your next payout.
  • •Your dashboard is the record of visits, sales and earnings. If something looks wrong, tell us within 30 days and we'll check it.

2. Getting paid

  • •Commissions and approved job fees are paid monthly once your balance owed is $25 or more. Smaller balances roll over. A commission becomes payable 30 days after the sale, once the refund and chargeback window has passed. Job fees are payable once your post is approved.
  • •We pay by the method we agree on with you (for example PayPal, Zelle or Venmo). Your dashboard shows each payout once it's sent.
  • •You're an independent creator, not an employee. You're responsible for your own taxes, and we may ask for a W-9 before paying you.
  • •You must be 18 or older to join. The program is open to anyone of working age, 18 and up, who lives in the Charlotte area. You must complete the Creator Academy before applying. Payouts go only to U.S. accounts, and we may ask you to confirm your age before paying you.

3. Creator jobs (visits and sponsored posts)

  • •Paid jobs are for Verified Creators. Your first job is a hosted (perk-only) trial; paid jobs open after one approved post. Verified status requires 5,000+ followers (or subscribers) on your main platform, 2%+ average engagement and a 40%+ Charlotte-area audience, plus consistent quality and on-time delivery. It is reviewed every quarter.
  • •Job offers are optional. Each offer shows the business, what to post, what you get (a hosted experience and/or a fee) and the post deadline. Accept or decline in your dashboard.
  • •Every job must meet NexLvl's quality standard: professional-looking (sharp, well lit, clear audio), clearly showing the business, and following the brief. Any tools are fine, including AI, as long as the result is high quality and honestly shows the real place. Label realistic AI images the way the platform requires.
  • •All NexLvl content, including posts that use your link, must have a Charlotte focus: Charlotte-area places, people, events or stories.
  • •Once you accept: visit at the agreed time, post by the deadline, include the brief's must-mentions, and paste your post link in your dashboard.
  • •We review submitted posts within 3 business days. We may ask for one round of changes (for example a missing tag or disclosure). Fees are paid after approval.
  • •Hosted experiences are for the scheduled visit only and have no cash value. If you can't make it or can't post on time, tell us as early as possible. Repeated no-shows or missed posts mean we stop offering jobs.
  • •Your opinions stay yours. We never require a positive review, only an honest post that includes the must-mentions.

4. Disclosure and conduct

  • •Always disclose. Use #ad, #partner or the platform's Paid Partnership label on any post with your link, a fee or a gifted experience. This is required by the FTC.
  • •No fake engagement, no buying followers or clicks, no spamming your link in comments or groups that don't allow it, and no paid ads bidding on "NexLvl" or "NexLvlCharlotte".
  • •Don't make claims about a business you don't know to be true.

5. Who owns the content

  • •You own what you create. You give NexLvlCharlotte and the featured business permission to reshare, embed and feature posts made for the program, with credit to you, on their own websites and social accounts.
  • •Using your content in paid ads needs your separate permission (and usually a fee).

6. Changes and ending

  • •Either side can end the partnership at any time by email. Commissions earned and jobs approved before that date are still paid.
  • •If we change rates or these terms, we'll email you first and ask you to sign the new version in your dashboard. Changes never reduce money you've already earned.
  • •We can pause or remove a creator who breaks these terms.

7. Liability, indemnity and protecting the NexLvl brand

  • •No guarantees. NexLvlCharlotte's website, guides, emails and social content are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including accuracy, fitness for a particular purpose and non-infringement. Events, prices, hours and availability change; confirm details with the business before you go.
  • •Third parties. Businesses, venues, tours, creators and advertisers we feature are independent third parties. We don't own or control them and aren't responsible for their products, services, premises, conduct, content or prices. Tours and experiences booked through partners such as Viator are governed by those providers' own terms. You take part in any activity at your own risk.
  • •Limit on liability. To the fullest extent the law allows, NexLvlCharlotte, its owner, team, partners and legal counsel will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim is limited to the amount you paid NexLvlCharlotte in the 12 months before the claim arose.
  • •Indemnity. You agree to defend, indemnify and hold harmless NexLvlCharlotte, its owner, team and counsel from any claims, losses, damages and costs (including reasonable attorneys' fees) arising from your content, your business, your products or services, your posts, your failure to disclose paid or gifted content, your breach of these terms, or your violation of any law or third party's rights.
  • •Our name and marks. NexLvlCharlotte, NexLvl, the NexLvl logo, the CLT Local badge and our content belong to NexLvlCharlotte. You may not use them, or suggest that we endorse you, without our written permission. Partners may use them only as we approve, and only while the partnership is active. All use stops when it ends.
  • •Brand standards. We may suspend or end a partnership immediately, and remove related listings or content, if a partner's conduct is unlawful, deceptive, hateful, harassing or unsafe, or would reasonably bring NexLvlCharlotte into public disrepute.
  • •Confidentiality. Pricing, dashboards, private links, reports and any non-public business information shared between us are confidential. Don't share them except as needed to perform this agreement or as required by law.
  • •Independent parties. Nothing here creates an employment, partnership, joint venture or agency relationship. Neither side can bind the other.
  • •Events beyond our control. We aren't responsible for delays or failures caused by events outside our reasonable control, such as outages, weather, venue closures or government actions.
  • •Everything else. These terms (with any written order or package details) are the entire agreement on this subject. If any part is found unenforceable, the rest stays in effect. Our not enforcing a term isn't a waiver of it. NexLvlCharlotte may assign these terms to a successor. Notices to us go to [email protected], and notices to you go to the email you gave us.

8. Resolving disputes: NexLvlCharlotte first, then our counsel, then arbitration

  • •Step 1 — Come to us first. Before taking any other action, you agree to send a written notice to NexLvlCharlotte at [email protected] (subject line "Legal Notice") describing the issue and what you want. We will both try in good faith to resolve it within 30 days.
  • •Step 2 — Review by our legal counsel. If it isn't resolved in Step 1, NexLvlCharlotte will refer the matter to its legal counsel, and both sides will try in good faith to settle it within a further 30 days.
  • •Step 3 — Binding arbitration. If the issue is still unresolved, it will be decided only by final, binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (for individuals acting for personal purposes) or its Commercial Arbitration Rules (for businesses, advertisers and creators), before a single arbitrator, in Mecklenburg County, North Carolina, or by video or written submissions where the rules allow. Fees are allocated as those rules require. The arbitrator's decision is final, and judgment on it may be entered in any court with jurisdiction.
  • •Completing Steps 1 and 2 is required before starting arbitration or any other proceeding. Any claim started without completing them may be dismissed or paused until they are completed.
  • •Individual claims only. Disputes are resolved only on an individual basis. You and NexLvlCharlotte each waive any right to a jury trial and to bring or join a class, collective or representative action. If this waiver is found unenforceable for a particular claim, that claim (and only that claim) will be decided by a court in Mecklenburg County, North Carolina, not by arbitration.
  • •Exceptions. Either side may bring an individual claim in small claims court in Mecklenburg County if it qualifies. NexLvlCharlotte may also ask a court for an injunction to stop misuse of its name, logos, badges, content or other intellectual property, or a breach of confidentiality.
  • •Time limit. To the extent the law allows, any claim must be raised with a Step 1 notice within one (1) year after it arises, or it is permanently barred.
  • •Governing law. These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules, and the Federal Arbitration Act governs this arbitration agreement. Any court proceeding permitted here will be in the state or federal courts located in Mecklenburg County, North Carolina.
