NEXLVLCHARLOTTE TERMS OF USE
Version 2026-10-v1
By using nexlvlcharlotte.com, buying a guide, signing up for emails or contacting us, you agree to these Terms of Use. Please read them, especially Section 6: it requires disputes to go to NexLvlCharlotte first, then to our legal counsel, and then to individual binding arbitration instead of court, and it waives jury trials and class actions.
1. What NexLvlCharlotte is
- •NexLvlCharlotte is an independent Charlotte city guide. Our recommendations are our own opinions. We work to keep information current, but things change, so always confirm details with the business directly.
- •Local first: independently owned Charlotte businesses get top billing and the CLT Local badge. Featuring a business is not a guarantee of its quality or safety.
2. Advertising, affiliate links and paid partnerships
- •Some listings, placements and posts are paid partnerships. They are labeled as sponsored, partner or ad content.
- •Some links (for example tours and experiences on Viator, and some travel links) are affiliate links. If you book or buy through them, we may earn a commission at no extra cost to you.
- •Creators in the NexLvl Creator Program may earn commissions or receive hosted experiences, and are required to disclose that in their posts.
- •Creators shown on our Influencers page are featured only because we like their work. We have no business relationship with them, don't pay or get paid by them, and earn nothing from their channels. Their feature isn't an endorsement of NexLvlCharlotte.
3. Digital guides
- •Guides are delivered digitally and immediately after purchase, for your personal, non-commercial use. Please don't copy, resell or redistribute them.
- •Because guides are delivered instantly, sales are final except where the law requires otherwise. If you have trouble accessing a guide you bought, contact us and we'll make it right.
4. Using the site
- •Don't misuse the site: no scraping or copying our content at scale, no interfering with how the site works, no posting unlawful, misleading or infringing material, and no impersonating NexLvlCharlotte or anyone else.
- •Anything you send us (tips, photos, reviews, applications) must be yours to share. You give us permission to use it to run and promote NexLvlCharlotte, with credit where practical.
5. Liability, indemnity and protecting the NexLvl brand
- •No guarantees. NexLvlCharlotte's website, guides, emails and social content are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including accuracy, fitness for a particular purpose and non-infringement. Events, prices, hours and availability change; confirm details with the business before you go.
- •Third parties. Businesses, venues, tours, creators and advertisers we feature are independent third parties. We don't own or control them and aren't responsible for their products, services, premises, conduct, content or prices. Tours and experiences booked through partners such as Viator are governed by those providers' own terms. You take part in any activity at your own risk.
- •Limit on liability. To the fullest extent the law allows, NexLvlCharlotte, its owner, team, partners and legal counsel will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim is limited to the amount you paid NexLvlCharlotte in the 12 months before the claim arose, or $100 if you paid nothing.
- •Indemnity. You agree to defend, indemnify and hold harmless NexLvlCharlotte, its owner, team and counsel from any claims, losses, damages and costs (including reasonable attorneys' fees) arising from your breach of these terms, or your violation of any law or third party's rights.
- •Our name and marks. NexLvlCharlotte, NexLvl, the NexLvl logo, the CLT Local badge and our content belong to NexLvlCharlotte. You may not use them, or suggest that we endorse you, without our written permission.
- •Events beyond our control. We aren't responsible for delays or failures caused by events outside our reasonable control, such as outages, weather, venue closures or government actions.
- •Everything else. These terms (with any written order or package details) are the entire agreement on this subject. If any part is found unenforceable, the rest stays in effect. Our not enforcing a term isn't a waiver of it. NexLvlCharlotte may assign these terms to a successor. Notices to us go to [email protected], and notices to you go to the email you gave us.
6. Resolving disputes: NexLvlCharlotte first, then our counsel, then arbitration
- •Step 1 — Come to us first. Before taking any other action, you agree to send a written notice to NexLvlCharlotte at [email protected] (subject line "Legal Notice") describing the issue and what you want. We will both try in good faith to resolve it within 30 days.
- •Step 2 — Review by our legal counsel. If it isn't resolved in Step 1, NexLvlCharlotte will refer the matter to its legal counsel, and both sides will try in good faith to settle it within a further 30 days.
- •Step 3 — Binding arbitration. If the issue is still unresolved, it will be decided only by final, binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (for individuals acting for personal purposes) or its Commercial Arbitration Rules (for businesses, advertisers and creators), before a single arbitrator, in Mecklenburg County, North Carolina, or by video or written submissions where the rules allow. Fees are allocated as those rules require. The arbitrator's decision is final, and judgment on it may be entered in any court with jurisdiction.
- •Completing Steps 1 and 2 is required before starting arbitration or any other proceeding. Any claim started without completing them may be dismissed or paused until they are completed.
- •Individual claims only. Disputes are resolved only on an individual basis. You and NexLvlCharlotte each waive any right to a jury trial and to bring or join a class, collective or representative action. If this waiver is found unenforceable for a particular claim, that claim (and only that claim) will be decided by a court in Mecklenburg County, North Carolina, not by arbitration.
- •Exceptions. Either side may bring an individual claim in small claims court in Mecklenburg County if it qualifies. NexLvlCharlotte may also ask a court for an injunction to stop misuse of its name, logos, badges, content or other intellectual property, or a breach of confidentiality.
- •Time limit. To the extent the law allows, any claim must be raised with a Step 1 notice within one (1) year after it arises, or it is permanently barred.
- •Governing law. These terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules, and the Federal Arbitration Act governs this arbitration agreement. Any court proceeding permitted here will be in the state or federal courts located in Mecklenburg County, North Carolina.
7. Changes
- •We may update these terms. The version and date at the top show the latest. Continuing to use the site after an update means you accept it. Changes to the dispute resolution section won't apply to a dispute we already know about.
